FAQs About Reporting Misconduct Allegations

All law enforcement agencies will start reporting completed administrative investigations into misconduct. How will that work?

Starting June 1, 2025, law enforcement agencies will submit to TCOLE a report of a completed administrative investigation of misconduct using a form called the Misconduct Investigation Report (MIR). The agency will submit the MIR in a timely manner, but no later than 30 days after separation from the agency.

What if the misconduct allegations are criminal?

Law enforcement agencies will still report to TCOLE, if criminal charges are filed against a licensee, a report of a completed criminal investigation of misconduct using the Criminal Charges Notification (E-1) form. The agency will submit the E-1 within 30 days of completion of the investigation.

What if an employee separates from an agency while the misconduct investigation is pending?

An investigation into the alleged misconduct of a license holder may not be terminated by the resignation, retirement, termination, death, or separation from employment. The agency will submit a report on the appropriate TCOLE form.

How long does an agency have to conclude an administrative investigation of misconduct?

Generally, administrative investigations should be completed within 180 days or within 30 days of separation, whichever occurs first.

What if the misconduct allegation is not sustained?

Law enforcement agencies will submit to TCOLE a report of all completed administrative investigations of misconduct regardless of disposition.

Law enforcement agencies that complete a criminal investigation of misconduct that does not result in criminal charges against a licensee are not required to submit an E-1 report to TCOLE.

What if the disciplinary action from an administrative misconduct investigation is under appeal?

The agency will notify TCOLE that the matter is under appeal. When the appeal is concluded, the agency will notify TCOLE of the disposition of the appeal within 30 days’ receipt of the decision.
